Terms and Conditions (Canada)

1. Introduction
These Terms and Conditions (“Agreement”) govern your access to and use of the money transfer services (“Service”) offered by UNITELLER CANADA ULC. (“UniTeller”, “we”, “us”, or “our”) through the UNITELLER CANADA ULC website and mobile application (“Platform”). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these terms, you must not use our Service.
2. Eligibility and Registration
– You must be at least 18 years of age and legally capable of entering into binding contracts to use the Service.
– You agree to provide truthful, accurate, and current personal information during registration and when using the Service.
– Only individuals may use the Service; entities may not register or conduct transactions.
3. Description of Services
– The Service allows you to send money to individuals in select international destinations (“Beneficiaries”).
– Each transaction (“Transaction”) includes a transfer fee and may involve currency exchange at a rate determined by UNITELLER CANADA ULC.
4. Payment Terms
– All transactions must be paid in Canadian dollars.
– You authorize us to charge your designated payment method (e.g., bank account, credit/debit card).
– UNITELLER CANADA ULC may retry failed payments using the same or different payment method provided.
– Your payment source may be validated via micro-deposit verification.
5. Transaction Limits and Restrictions
– The Service is subject to daily and aggregate limits, including a general cap of $1,999 USD/day per user.
– Additional documentation may be required for higher limits or specific jurisdictions.
– You must not send money on behalf of third parties or for commercial purposes.
– Prohibited uses include funding illegal activities, fraud, or transactions involving designated government watch lists.
6. Beneficiary Requirements
– The Beneficiary must present valid ID and transaction details to collect funds.
– UNITELLER CANADA ULC is not liable for delays caused by the availability of cash or recipient identification issues.
7. Cancellations and Refunds
– Transactions may be canceled for a full refund within 30 minutes of submission, provided the funds have not been picked up or deposited.
– Refunds are issued in Canadian dollars only and are subject to verification.
– You may dispute errors within 180 days of the transaction by contacting customer support.
– Refunds are processed in Canadian dollars and may differ from the original amount due to exchange rate fluctuations.
8. Privacy and Data Protection
Your use of the Service is subject to our Privacy Policy, which outlines:
– The types of personal data collected (e.g., name, ID, transaction history, recipient data).
– How your data is used: identity verification, transaction processing, legal compliance, marketing, etc.
– How we protect your data: encryption, access controls, and security protocols.
– Your rights: access, correction, and limitation of data sharing with affiliates and third parties.
– Your ability to opt out of marketing-related data sharing by contacting us.
– Your personal information may be stored or processed outside of Canada, including in the United States, and may be subject to the laws of those jurisdictions.
9. Intellectual Property
All content, trademarks, logos, and service marks on the Platform are the property of UNITELLER CANADA ULC or its affiliates. You may not copy, modify, or use them without permission.
10. Limitation of Liability
Except where prohibited by law:
– UNITELLER CANADA ULC´s liability is limited to the amount of the Transaction and applicable fees, plus a maximum of $500 USD.
– UNITELLER CANADA ULC is not liable for indirect, incidental, or consequential damages, including data loss or business interruption.
– This limitation shall not apply to losses arising from our gross negligence or willful misconduct.
11. Dispute Resolution
– All disputes are governed by the laws of Nova Scotia, Canada.
– Disputes must be resolved through binding arbitration, unless otherwise required by applicable law.
– Improperly filed litigation may result in legal costs awarded to UNITELLER CANADA ULC.
– To the extent permitted by law, all disputes shall be resolved exclusively through binding arbitration. This clause shall not apply in provinces where such provisions are unenforceable.
12. Termination
UNITELLER CANADA ULC may suspend or terminate your access to the Service at any time, with or without cause. You may terminate your account by ceasing use of the Service and contacting customer support.
Users may terminate their account at any time by ceasing use of the Service. Any unused funds or pending transactions will be handled per applicable law.
13. Changes to Terms
We may amend these Terms at any time. Material changes will be notified to users at least 30 days prior to taking effect, where required by law.
