By participating in this promotion, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

Promotion Description

The New Customer Loyalty Rewards Promotion (the “Promotion”) rewards eligible new customers who successfully complete two (2) qualifying paid transactions, each with a minimum value of USD $250,  within their first thirty (30) calendar days of signing up with uLink. Upon satisfaction of the qualifying conditions set forth herein, the customer will receive one hundred (100) Reward Stars, equivalent to a five-dollar ($5.00 USD) value, redeemable as cashback into their activated uLink e-wallet.

Eligibility

To be eligible for this Promotion, a participant must:

• Be a new uLink customer with zero (0) previously paid transactions at the time of enrollment;
• Successfully complete two (2) paid qualifying transactions of two hundred and fifty dollars ($250.00 USD) or more each; and
• Complete both qualifying transactions within thirty (30) calendar days of the date of account registration with uLink.

This Promotion is limited to one (1) offer per customer and is non-transferable. Employees of uLink, its affiliates, subsidiaries, and any other licensed remittance company are expressly excluded from participation. Participation is void where prohibited by applicable law, statute, or regulation.

Qualifying Transactions

The following transaction types are eligible and qualify toward fulfillment of the Promotion requirements, provided each transaction has a minimum value of USD $250:

• International Money Transfers (Send Money)
• Bill Payments
• Phone Reloads
• OMC Gift Card Purchases
• AFORE Transactions
• Trust Payments

Only transactions that are fully paid and successfully settled during the Promotion Period will be considered qualifying transactions.

Reward

Upon successful completion of both qualifying transactions within the prescribed thirty (30)-calendar-day window, the eligible customer will receive one hundred (100) Reward Stars redeemable as cashback into their activated uLink e-wallet. One hundred (100) Reward Stars are equivalent to five dollars ($5.00 USD) in value and are subject to the terms and conditions governing uLink’s Loyalty Rewards Program, as may be amended from time to time.

Reward Stars have no cash value and may not be combined with any other offer unless expressly permitted by uLink in writing. Reward Stars are non-transferable and may not be assigned to another customer under any circumstances. Reward Stars accumulate and do not expire.

Promotion Period

This Promotion is valid from xx/xx/xxxx and shall remain in effect indefinitely until paused or terminated by uLink. uLink reserves the right, at any time and without prior notice, to pause, suspend, modify, or permanently terminate this Promotion at its sole discretion, with no liability to uLink. Any qualifying transactions initiated prior to the effective date of a pause or termination shall be honored subject to the terms herein.

Cancellations and Forfeitures

If a qualifying transaction is cancelled, reversed, or refunded by either the customer or uLink, such transaction shall not count toward the Promotion requirements, and any Reward Stars previously issued as cashback into the uLink e-wallet in reliance upon such transaction may be voided and reclaimed by uLink. uLink reserves the right to void any Reward Stars issued in connection with fraudulent activity, transactions that violate the uLink User Agreement, or any transaction not compliant with applicable law.

Fraud and Abuse

uLink reserves the right to investigate and, at its sole discretion, disqualify any participant suspected of manipulating or abusing the Promotion, engaging in fraudulent activity, or otherwise violating these Terms and Conditions or the uLink User Agreement. This Promotion is intended for personal, non-commercial use only. Any commercial exploitation of this Promotion, as determined by uLink in its sole discretion, is expressly prohibited.

Privacy

All personal information collected in connection with this Promotion shall be processed in accordance with uLink’s Privacy Policy, available at www.ulink.com. By participating in this Promotion, you consent to the collection, use, and processing of your personal information as described therein.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ULINK BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DAMAGES OF ANY KIND ARISING FROM OR IN CONNECTION WITH YOUR PARTICIPATION IN THIS PROMOTION, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, AND/OR CONSEQUENTIAL DAMAGES, EVEN IF ULINK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

ALL WARRANTIES, EXPRESS OR IMPLIED, ARE HEREBY DISCLAIMED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ULINK MAKES NO REPRESENTATION OR WARRANTY WITH RESPECT TO ANY RESULTS OBTAINABLE THROUGH THIS PROMOTION.

The uLink User Agreement, including its provisions governing limitation of liability and dispute resolution, is expressly incorporated herein by reference.

Dispute Resolution and Governing Law

Any dispute, controversy, or claim arising out of or relating to this Promotion or these Terms and Conditions shall be resolved exclusively through binding arbitration on an individual basis, and not in a court of law, except that either party may assert claims in small claims court where eligible. The Federal Arbitration Act and federal arbitration law shall govern the interpretation and enforcement of this arbitration provision.

You acknowledge that there is no judge or jury in arbitration, and that judicial review of an arbitration award is limited. Notwithstanding the foregoing, an arbitrator may award on an individual basis the same forms of relief available in a court of law, including injunctive and declaratory relief and statutory damages, and shall be bound by these Terms and Conditions as a court would be.

These Terms and Conditions shall be governed by and construed in accordance with the Federal Arbitration Act, applicable federal law, and the laws of the State of New Jersey, without regard to its conflict of law principles.

General Provisions

uLink is the final authority with respect to all matters relating to this Promotion and the interpretation of these Terms and Conditions. This Promotion is subject to force majeure events beyond uLink’s reasonable control. uLink reserves the right to add, modify, or amend any and all terms of this Promotion at any time and without prior notice, or to substitute the Promotion with an alternative offer of comparable or greater value, without liability to uLink.
